PriceZone Support Forum – Terms and Conditions

Welcome to the PriceZone Support Forum (the “Forum”), a community discussion board provided by PriceZone (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Forum. By accessing or using the Forum, you agree to be bound by these Terms and all policies referenced herein. If you do not agree to these Terms, you may not access or use the Forum.
1. Acceptance of Terms
Your access to and use of the PriceZone Support Forum is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Forum.
2. Forum Purpose
The PriceZone Support Forum is intended to provide a platform for users to discuss PriceZone products and services, share tips, ask questions, and assist other users. It is not intended as a substitute for official PriceZone customer support channels.
3. User Accounts
- Registration: To participate in certain features of the Forum, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- Account Security: You are responsible for safeguarding the password that you use to access the Forum and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
- Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice or liability, for any reason, including but not limited to, a breach of these Terms.
4. User Conduct and Content
You agree to use the Forum only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Forum. You agree not to:
- Post Prohibited Content: Post, upload, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Infringe Intellectual Property: Post content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
- Spam/Commercial Content: Post unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
- Personal Information: Post personal information about yourself or others (e.g., names, addresses, phone numbers, email addresses, financial information) without explicit consent.
- Malicious Code: Upload or transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Harassment/Bullying: Harass, stalk, or otherwise defame or violate the legal rights (such as rights of privacy and publicity) of others.
- Impersonation: Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Disruption: Disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Forum are able to type, or otherwise act in a manner that negatively affects other users’ ability to engage in real-time exchanges.
- Illegal Activities: Engage in any activities that violate any applicable local, state, national, or international law or regulation.
5. Content Ownership and License
- Your Content: You retain all ownership rights in the content you submit, post, or display on or through the Forum.
- License to PriceZone: By submitting, posting, or displaying content on or through the Forum, you grant PriceZone a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such content in connection with the operation of the Forum and PriceZone’s business. This license includes the right to use your content for promotional purposes and in other media.
- No Obligation to Post: You agree that PriceZone has no obligation to post or use any content you submit.
6. Monitoring and Moderation
We reserve the right, but are not obligated, to:
- Monitor or review content posted on the Forum.
- Remove or refuse to post any content for any reason.
- Take any action with respect to any content that we deem necessary or appropriate in our sole discretion, including if we believe that such content violates these Terms, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Forum or the public, or could create liability for PriceZone.
- Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
- Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Forum.
7. Intellectual Property Rights
The Forum and its original content, features, and functionality are and will remain the exclusive property of PriceZone and its licensors. The Forum is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PriceZone.
8. Links to Other Websites
The Forum may contain links to third-party websites or services that are not owned or controlled by PriceZone.
PriceZone has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that PriceZone shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
9. Disclaimer of Warranties
THE FORUM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PRICEZONE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE FORUM OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE FORUM. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, PRICEZONE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. PRICEZONE DOES NOT WARRANT THAT THE FORUM, ITS SERVERS, OR EMAIL SENT FROM PRICEZONE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Limitation of Liability
IN NO EVENT SHALL PRICEZONE, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE FORUM; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE FORUM; (III) ANY CONTENT OBTAINED FROM THE FORUM; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
11. Indemnification
You agree to defend, indemnify, and hold harmless PriceZone and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of:
a) your use and access of the Forum, by you or any person using your account and password;
b) a breach of these Terms; or
c) Content posted by you on the Forum.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Forum, and supersede and replace any prior agreements we might have between us regarding the Forum.
13. Changes to Terms and Conditions
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Forum after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Forum.
